Step-by-Step PF Registration Process

All employees meeting the salary criteria must be covered. Contract workers, temporary staff, and probationers are all eligible. Excluding them is a violation.

PF is computed on Basic + DA. Some companies incorrectly include or exclude components like HRA, special allowance, or conveyance. The Supreme Court has clarified that allowances that are universally, necessarily, and ordinarily paid form part of basic wages for PF calculation.

If you have multiple branches, each branch may need a separate PF/ESIC code depending on whether they fall under the same regional office jurisdiction.

Frequently Asked Questions
Can a company with fewer than 20 employees register for PF voluntarily?
Yes. Companies with fewer than 20 employees can apply for voluntary PF registration. This requires the consent of all employees and the employer. Once voluntarily registered, the establishment comes under the permanent purview of the EPF Act. This means you cannot deregister later even if you no longer want PF. Voluntary registration is often done by startups that want to offer PF benefits to attract better talent.
What happens if I delay PF or ESIC registration?
If registration is delayed, the authorities will register you retrospectively from the date the Act became applicable (when you crossed the employee threshold). You will be required to pay all back contributions from that date, plus interest at 12% per annum, plus damages ranging from 5% to 25% of the arrears. In severe cases, prosecution under Section 406/409 of the Indian Penal Code can also be initiated.
Is ESIC applicable if my office is not in an ESIC-notified area?
No. ESIC is only applicable in areas notified by the ESIC. If your establishment is located in a non-notified area, ESIC registration is not required. However, the list of notified areas is expanding regularly. Check the ESIC website for the current list of notified areas. If any of your branch offices are in notified areas, ESIC becomes applicable for employees in those branches.
Do contract workers need to be covered under PF and ESIC?
Yes. If contract workers meet the eligibility criteria (salary threshold), they must be covered. The principal employer is ultimately responsible for ensuring PF and ESIC compliance for contract workers. Even if you engage workers through a contractor, if the contractor fails to comply, the liability falls on the principal employer. Ensure your contractor agreements include PF/ESIC compliance clauses and regularly verify the contractor’s filings.
